Call to Action

House Bill 28 Domestic Partner Rights & Responsibilities has been changed to *HB 9.  This version of this legislation is the first bill to be presented to the House Consumer and Public Affairs Committee and has an emergency clause.  HB 9 has also been sent to the House Judiciary Committee, and we can expect a hearing on this bill very quickly, first in the HCPAC and then in the HJC.  The emergency clause is an attempt to get this bill through these committees and onto the floor of the house for an emergency vote so that those of us who oppose such legislation will not have time to act.

HB 9 could be heard in the HCPAC as early as this Thursday, January 17th, 2008 at 1:30pm in room 315 of the State Capital.

Please pray for the following Representatives and contact them to request that they vote NO on the Domestic Partner Rights and Responsibilities bill.  If any of these is your Representative be sure to call them directly.  Remember that a constituent request is worth more than the requests of hundreds of lobbyists and non-constituents.

Please vote NO on HB 9 Domestic Partner Rights and Responsibilities.

Domestic partnerships between same sex partners have already been created in New Mexico by written contracts.  There is no need for HB 9.

HB 9 states that a domestic partnership (which may be between two persons of the same sex) is not marriage, but then turns around and grants to each domestic partner the rights and responsibilities of a spouse (which is a marriage partner, husband or wife) under New Mexico law.  A domestic partner is a marriage partner.  As a further contradiction, HB 9 states that a person or entity cannot discriminate against a domestic partner or domestic partnership on the grounds that the domestic partner is not a spouse or is not in a marriage.

HB 9 fails truth in advertising because it will make domestic partnerships equal to marriage.

New Mexico adopted a mandatory constitutional provision prohibiting polygamy in order to become a state in 1912.  The U.S. Supreme Court upheld laws prohibiting polygamy based upon marriage meaning only the union of a man and a woman.  Since HB 9 will make domestic partnerships equal to marriage, these domestic partnerships are unconstitutional in New Mexico.
